Terms of Service

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Webex LLC ("we," "us," or "our"), concerning your access to and use of our website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").
/01Agreement to Terms
By accessing the Site, you agree that you have read, understood, and agreed to be bound by all of these Terms of Service. If you do not agree with all of these Terms of Service, then you are expressly prohibited from using the Site and you must discontinue use immediately.
/02Intellectual Property Rights
Unless otherwise indicated, the Site and our services are our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein are owned or controlled by us.
For custom software development and AI automation services, intellectual property rights to the final delivered systems are transferred to the client upon full payment, as specified in individual Master Service Agreements (MSAs).
/03Payment and Fees
We bill for our services based on project milestones or retainer agreements as outlined in our service contracts. All payments must be made in accordance with the schedule defined in your specific contract.
Every project is quoted at a fixed price agreed before work begins. We do not bill hourly and we do not raise the agreed price mid-build; any work outside the agreed scope is quoted separately and started only once you approve it in writing.
/04Delivery Guarantee
This section states the delivery promise made on our website so that it is a contractual term and not only a marketing claim. It applies to every standard build unless your individual scope document says otherwise.
The promise. Your site will be live within 7 working days. If we miss that date for any reason within our control, the build is free: you pay nothing for the build itself, and any build fee already paid is refunded in full. Hosting, third-party licences and any care plan already delivered are not included in the refund.
When the clock starts. Day 1 is the first working day after both of these have happened: you have signed the scope document, and you have supplied the materials listed in it (typically logo, photos, services, service areas, and contact details). If either is outstanding, the clock has not started.
When the clock pauses. The clock pauses only while we are waiting on something from you: a decision, an asset, an approval, or access to a domain or account. We will tell you in writing on the day a pause begins and on the day it ends. Time spent waiting on you does not count against the 7 working days, and no other pause applies.
What "live" means. The agreed pages are published and publicly reachable on your domain, or on a staging domain if your domain is not yet available to us for reasons outside our control. Post-launch revisions, content you supply later, and optional extras do not affect whether the delivery date was met.
The pilot. The €400 pilot covers one page or one system, delivered within one week. If you proceed to a full build within 90 days, the €400 is credited in full against it. If we do not deliver what was agreed in the pilot scope, the €400 is refunded in full.
Working days are Monday to Friday, excluding public holidays in the Netherlands.
/05Confidentiality and NDA
A mutual non-disclosure agreement is standard on every engagement and is signed before we receive any of your material. There is no charge for it.
For agency and white-label clients specifically: we treat your client relationship as yours. We will not contact your client, identify ourselves to them, or approach them for work during the engagement or afterwards. Work delivered to you is not published in our portfolio, on our website, or on our social channels, and is not used as a case study or reference, unless you give written permission for a specific piece of work.
/06Limitation of Liability
In no event will we or our directors, employees, or agents be liable to you or any third party for any indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Site or our services. Nothing in these Terms limits liability that cannot be limited under applicable law, and nothing here limits the delivery guarantee in section 04.
/07Governing Law
For clients established in the United States, these Terms are governed by the laws of the State of Montana, and the courts of Montana have jurisdiction over any dispute arising in connection with them.
For clients established in the European Union, the European Economic Area or the United Kingdom, these Terms are governed by the laws of the Netherlands, and the competent courts of Amsterdam have jurisdiction. Where you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of your country of residence, or of your right to bring proceedings there.
Before starting proceedings, both parties agree to attempt to resolve the dispute directly, in writing, within 30 days.
